SeafarerKit — Terms of Use

Last updated: 29 October 2026

1. Provider and scope

SeafarerKit is provided by Marine Solutions SD Group.
Address: 3–7 Kyianivskyi Lane, Office 110A, Kyiv, 04053, Ukraine.
Email: support@msdmarine.com

These Terms describe use of SeafarerKit and its related support and Pro services. The Privacy Policy explains personal-information processing. The Subscriptions, Lifetime Access & Refunds policy explains purchases. The Methodology & Limitations notice explains how to interpret calculations and reports. These documents must be read together, without restricting rights that cannot lawfully be excluded.

2. Nature of the application

SeafarerKit is a local recordkeeping application for contracts, documents, financial entries and work/rest journals. A seafarer profile is not an online SeafarerKit account.

The application does not execute salary payments, bank transfers or purchases of goods. It does not issue maritime qualifications, verify the authenticity of your documents, provide medical or legal advice, or automatically certify compliance with a flag administration's requirements.

3. Permitted use and licence

Subject to applicable store rules, you may use the application for lawful personal or professional recordkeeping on devices you own or control. You must have legal capacity to enter the applicable purchase or usage arrangement, or obtain any permission required by law.

For an application obtained through Apple's App Store, the standard Apple Licensed Application End User License Agreement governs the software licence unless a valid custom EULA is supplied through that store. These Terms supplement the application's service arrangements and do not replace or contradict that licence or Apple's mandatory usage rules:

For Android, we grant a limited, non-exclusive right to use the application within these Terms and the applicable Google Play usage rules. No ownership of the application's software, branding or design is transferred to you.

Third-party and open-source components remain subject to their applicable licences. Nothing here restricts rights that those licences or mandatory law grant you.

4. Your records and responsibilities

You retain your rights in the information and files you enter. You do not grant us ownership of your journal by using SeafarerKit.

Enter accurate information and review dates, calculation settings, currency conversions, work/rest periods and reports before relying on them. Keep your device secure and maintain usable backups.

Only record, import or share information you are authorised to process. When keeping named crew records, follow applicable employment, privacy, access and retention requirements. Do not falsify actual hours, certificates, signatures or other official records.

You must not unlawfully access another person's records, interfere with purchase verification, use forged purchase proofs, distribute unauthorised copies of the software or use the application to infringe others' rights. Restrictions on reverse engineering apply only to the extent permitted by law and relevant component licences.

5. Free features and Pro

Free features and Pro requirements are described in the application. Pro currently adds advanced recordkeeping, financial, crew and reporting tools. The purchase screen must explain the offer before you confirm payment.

Selecting a plan does not itself activate Pro. Access is established through a verified store purchase. Subscriptions and Lifetime Pro are different purchase types and are governed by the purchase policy and originating store's terms.

Expiration or cancellation of paid access does not automatically delete your saved records. Paid editing or creation may become unavailable; existing information remains accessible under the application's Free and archive-access rules.

6. Local storage, backups and exports

Ordinary journal records are stored locally. We do not provide an automatic cloud copy of your seafarer journal.

Export and verify a backup before replacing a device, reinstalling, deleting records or intentionally replacing data through restore. Protect the backup password; we cannot reset it or reconstruct a lost journal without your usable backup.

A backup restores compatible records, not a store purchase entitlement. Restore Pro separately through the originating store account.

Sharing a report or backup sends it to the recipient or service you select. Review its contents and your authority to disclose them. Deleting the original entry does not recall exported copies.

7. Calculations, warnings and official use

Salary totals, reminders and work/rest checks depend on the data and settings used. They are not substitutes for your employment agreement, payslip, official instructions or independent review.

An absence of warnings, a completed green calendar day or a generated PDF is not a certificate of legal compliance. Future plans remain plans until accurately recorded as actual events. Verify acceptance requirements before using reports as official shipboard records.

8. Connectivity and availability

Ordinary use of stored records is available offline. Purchasing, restoring or checking purchases, obtaining updates and contacting online services require a connection. A subscription may need renewed verification to reflect a new paid period.

Availability can be affected by your device, operating system, permissions, storage, connectivity and third-party stores or infrastructure. No promise of uninterrupted or error-free operation overrides the support and remedies you are entitled to under applicable law.

9. Support, updates and changes

Report issues to support@msdmarine.com. Do not include passwords or unnecessary personal or crew information.

We may issue corrections, security updates and compatible feature changes. Material changes to these Terms will be identified through an appropriate notice and advance notice where required by law. New terms will not retrospectively remove mandatory rights or paid entitlements already promised for an existing paid period.

10. Responsibility and consumer rights

Use reasonable care when entering and sharing records. The application cannot validate facts that have not been entered or determine every employer-specific or flag-specific requirement.

Nothing in these Terms excludes statutory guarantees, mandatory refund or withdrawal rights, remedies for defective digital content, or liability that cannot lawfully be limited. In particular, these Terms do not exclude responsibility for fraud, intentional misconduct, gross negligence, or death or personal injury where such exclusion is prohibited.

We do not guarantee the outcome of a claim about wages, an inspection or a decision made by an employer or authority. This does not remove responsibility imposed on us by applicable law for the application or services we supply.

11. Ending use and disputes

You may stop using the application and remove your local data. Uninstalling does not cancel a subscription; manage renewal through the originating store.

These Terms are governed by Ukrainian law to the extent permitted by applicable law. Mandatory protections, applicable laws and access to courts or consumer authorities available to you in your country are not displaced by this provision. No exclusive Kyiv-court requirement is imposed on consumers where mandatory law provides otherwise.
